Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the Task Management System — Enterprise Edition platform (the “Service”) provided by Devix.com (“we”, “us”, “our”). By creating an account, signing in, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a web-based task and project management platform that allows users and organizations to create, organize, assign, collaborate on, and track work. Features may include personal lists, shared project lists, comments, attachments, dashboards, notifications, and real-time updates. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, to improve security, performance, or functionality.
2. Eligibility and accounts
- You must be at least 16 years old and legally able to enter into a binding agreement.
- You are responsible for providing accurate registration information and keeping your credentials confidential.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly of any unauthorized access or security breach related to your account.
- We may refuse, suspend, or terminate accounts that violate these Terms or pose a security or legal risk.
3. Organization and administrator control
If you use the Service through an organization, your administrator may control access, permissions, roles, and data retention. The organization is responsible for how its users use the Service and for ensuring compliance with applicable laws and internal policies.
4. Acceptable use
You agree not to:
- use the Service for unlawful, fraudulent, harmful, or abusive purposes;
- upload malware, attempt unauthorized access, probe vulnerabilities, or interfere with the Service’s operation;
- reverse engineer, decompile, copy, scrape, or resell the Service except as expressly permitted by law or written authorization from Devix.com;
- infringe intellectual property, privacy, or other rights of Devix.com or third parties;
- harass, defame, or distribute illegal, obscene, or hateful content through the Service;
- overload, spam, or automate access in a manner that degrades the Service for others.
We may investigate violations and take appropriate action, including content removal, account suspension, and legal remedies.
5. Your content
You retain ownership of content you submit to the Service (“User Content”), including tasks, files, comments, and project data. By submitting User Content, you grant Devix.com a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content solely to operate, secure, backup, and improve the Service as directed by you and your organization’s settings.
You represent that you have all rights necessary to submit User Content and that it does not violate these Terms or applicable law. You are solely responsible for User Content and for maintaining appropriate backups where required by your business needs.
6. Our intellectual property
The Service, including its software, source code, design, layout, branding, documentation, logos, and all related intellectual property, is owned by or licensed to Devix.com and is protected by copyright, trademark, and other laws.
Except for the limited right to use the Service in accordance with these Terms, no license or ownership rights are granted to you. You may not use the name “TaskManagement”, “Devix.com”, or any related marks without our prior written consent.
7. Third-party services
The Service may integrate with third-party authentication providers (such as Google or Apple) or other external services. Your use of those services is subject to their own terms and privacy policies. Devix.com is not responsible for third-party services outside our reasonable control.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Availability and support
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, network issues, or events beyond our reasonable control may cause temporary downtime. Support is provided on a reasonable-efforts basis unless a separate written support agreement applies.
10. Fees
If the Service is offered free of charge or under a specific license for your deployment, no fees apply unless otherwise agreed in writing. We reserve the right to introduce or change pricing for future offerings with appropriate notice where required.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continued provision creates risk to the Service or other users. Upon termination, your right to use the Service ends, but provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will remain in effect.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE SECURE OR ERROR-FREE, OR THAT DATA WILL NEVER BE LOST OR CORRUPTED.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVIX.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).
14. Indemnification
You agree to defend, indemnify, and hold harmless Devix.com and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.
15. Governing law and disputes
These Terms are governed by the laws of the Sultanate of Oman, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the Sultanate of Oman, unless mandatory local consumer protection laws require otherwise.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Material changes may also be communicated through the Service or by other reasonable means. Continued use after changes take effect constitutes acceptance of the updated Terms.
17. General provisions
- Entire agreement: These Terms, together with the Privacy Policy and any written agreement with Devix.com, constitute the entire agreement regarding the Service.
- Severability: If any provision is held invalid, the remaining provisions remain in full force.
- No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations as part of a business transfer.
